With Writ Denied, Spirit Proceedings Move to Arbitration

On February 18, 2022, the Nevada Supreme Court (Supreme Court) denied a petition for writ of mandamus (the writ) filed by Nevada Insurance Commissioner Barbara Richardson.

Commissioner Richardson filed the writ on April 1, 2021, in response to a ruling in Eighth Judicial Court of Nevada (District Court) that stayed all proceedings in the liquidation of Nevada-domiciled Spirit Commercial Auto Risk Retention Group, Inc. (Spirit) pending arbitration. With the writ denied the Spirit proceedings will now proceed in arbitration.

Commissioner Richardson and the Nevada Department of insurance had no comment on the decision.
